These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of all content, services, digital products, submission features, and other materials available at https://www.recollectionswithin.com (the “Service”) operated by Recollections Within LLC (“we,” “us,” or “our”).

Your access to and use of our Services are conditioned upon your acceptance, without modification, of these Terms along with our Privacy Policy and any other policies referenced on the Site. By using any part of our Services, you agree to be bound by these Terms. If you do not agree, you must not access or use our Services.

1. Intellectual Property

The Service, including its original content, features, functionality, branding, design, and structure, is and will remain the exclusive property of Recollections Within LLC and its licensors, except for User Content submitted by contributors. This Agreement does not transfer any intellectual property rights from us to you. All rights, titles, and interests remain solely with Recollections Within LLC and its licensors.

You may interact with or use third-party services, products, or applications (“Third-Party Services”) through our Service. These may include payment processors, email services, form builders, analytics tools, and media or hosting tools used in connection with the Service.

By using Third-Party Services, you acknowledge:

3. User Submissions and The Quilt

Certain areas of the Service allow users to submit content, including written stories, audio recordings, video, photographs, visual art, and other materials (“User Content”), including submissions to The Quilt.

By submitting User Content, you acknowledge and agree that:

You are solely responsible for your User Content and must ensure it does not violate any law, these Terms, or the rights of any third party.
You represent that the User Content is your original work, or that you have all necessary rights, licenses, permissions, and consents to submit and share it through the Service.
You retain ownership of your User Content.
By submitting User Content to Recollections Within, you grant Recollections Within LLC a non-exclusive, royalty-free license to review, store, reproduce, display, publish, curate, format, and distribute your User Content solely in connection with operating, preserving, presenting, and promoting Recollections Within and its related projects, including The Quilt, newsletters, curated features, exhibitions, anthologies, social media features, shop-related features, and other Recollections Within publications or project contexts.
This license is granted so that we can receive, review, curate, preserve, and present submissions as part of the archive. It does not transfer ownership of your work to us.
Submission does not guarantee publication, inclusion, or continued display.
We reserve the right to review, decline, edit for clarity, formatting, accessibility, or presentation, remove, archive, redact, or limit access to User Content at our discretion while preserving the heart of the work.
We may use the name, pseudonym, attribution, or anonymity preference you provide in connection with your submission, but we reserve the right to adjust attribution or withhold publication if needed for safety, privacy, editorial, or legal reasons.
You should not submit confidential information, private information belonging to another person, or content that you do not wish to be stored, reviewed, or potentially published in connection with the Service.

4. No Professional Advice or Therapeutic Relationship

Recollections Within is a cultural and editorial project. The Service and any related content, submissions, responses, or communications are provided for informational, creative, and archival purposes only. They do not constitute therapy, counseling, medical advice, legal advice, or professional advice of any kind, and your use of the Service does not create a therapist-client, attorney-client, fiduciary, or other professional relationship.

5. Purchases and Shop Items

From time to time, the Service may offer products, digital goods, or other items for purchase. By making a purchase, you agree to provide current, complete, and accurate billing and payment information.

We reserve the right to refuse or cancel any order at our discretion, including in cases of product or pricing errors, suspected fraud, or inventory limitations. Additional terms relating to purchases, refunds, shipping, or digital delivery may be provided on the relevant pages and are incorporated into these Terms by reference.

6. Prohibited Uses

You agree not to use the Service:

7. Age Requirement for Submissions

The Service is intended for adults and is not directed to children. You may not submit content to The Quilt if you are under 18 years of age.

We reserve the right to remove or disable access to content that we believe may infringe the rights of others.

9. Termination

We may suspend or terminate your access immediately for any breach of these Terms. You may discontinue use of the Service at any time. Surviving provisions include ownership, licenses granted, disclaimers, indemnity, and limitations of liability.

Our Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee uninterrupted or error-free access, publication of any submission, or the availability of any particular feature. You use the Services at your own risk.

To the fullest extent permitted by law, Recollections Within LLC and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, your submissions or participation, third-party conduct or content, or unauthorized access, even if advised of the possibility of such damages.

12. Indemnification

You agree to indemnify and hold harmless Recollections Within LLC and its affiliates against all claims, damages, and expenses arising from your violation of these Terms, misuse of the Service, or submission of User Content that infringes the rights of any third party or gives rise to a legal claim.

13. Jurisdiction and Applicable Law

These Terms are governed by the laws of the State of New Mexico, United States. Any disputes will be resolved exclusively in state or federal courts located in Bernalillo County, New Mexico, United States.

14. Changes to These Terms

We may modify these Terms at our discretion. Material changes will be communicated via website notice and/or email with a reasonable effective date. Continued use after changes means acceptance. If you disagree, stop using the Service.

15. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy and any other policies referenced on the Site, constitute the entire agreement.
Waiver: Failure to enforce any term is not a waiver of that term.
Severability: Invalid provisions will be replaced to reflect original intent without affecting the remainder.
Assignment: You may not assign rights; we may assign our rights without restriction.
