These Terms and Conditions (“Terms,” “Agreement”) govern your access to and use of all content, services, and digital products available at https://www.recollectionswithin.com (the “Service”) operated by Recollections Within LLC (“we,” “us,” or “our”).

Your access to and use of our Services are conditioned upon your acceptance, without modification, of these Terms along with our Privacy Policy, Code of Conduct, and Community Values. By using any part of our Services, you agree to be bound by these Terms. If you do not agree, you must not access or use our Services.

1. Intellectual Property

The Service, including its original content, features, and functionality, is and will remain the exclusive property of Recollections Within LLC and its licensors. This Agreement does not transfer any intellectual property rights from us to you. All rights, titles, and interests remain solely with Recollections Within LLC and its licensors.

2. Third-Party Services

You may interact with or use third-party services, products, or applications (“Third-Party Services”) through our Service. These may include payment processors (Stripe, PayPal), email services (MailPoet), forum software (wpForo), form builders (Forminator), and analytics tools (Google Analytics).

By using Third-Party Services, you acknowledge:

Use of these services is at your own risk.
We are not responsible or liable for Third-Party Services or their content.
We disclaim liability for any damage or loss resulting from your use of such services or content.

3. Accounts and Memberships

Account Creation: When creating an account (free or paid membership), you agree to provide accurate and complete information.
Account Responsibility: You are responsible for all activities under your account and must safeguard your login credentials. Notify us immediately at [email protected] if you suspect unauthorized use or any security breach.
Membership Terms: Access to some features is provided through memberships (The Seeker [free], The Weaver, The Keeper, The Guide). Terms, pricing, billing, and benefits are detailed on our Memberships page. By purchasing a membership, you agree to those terms.
Automatic Renewal: Paid memberships automatically renew unless cancelled. You will be charged the applicable fees and taxes on your payment method at the end of each billing cycle.
Cancellation: You may cancel anytime via your Member Account page. Access continues through the current billing period. No refunds for partial periods unless specified in our Refund Policy.

4. User-Generated Content & Community Guidelines

We encourage sharing and connection through personal narratives. By submitting content (“User Content”) such as stories for “The Quilt” or posts in “The Common Thread” forum:

You are solely responsible for your content and must ensure it does not violate laws or third-party rights.
By posting, you grant Recollections Within LLC a non-exclusive, royalty-free, worldwide, perpetual, sublicensable license to use, modify, publish, distribute, and display your User Content for operating, marketing, and improving the Service. You retain ownership of your content.
We reserve the right to moderate, edit, or remove content violating these Terms, the Code of Conduct, or Community Values.
Use of our forums and story submissions must follow our Code of Conduct and Community Values.

5. Prohibited Uses

You agree not to use the Service:

In violation of any applicable law or regulation.
To exploit, harm, or attempt to harm minors.
To send unauthorized advertising, spam, or solicitations.
To impersonate others or misrepresent your affiliation.
To infringe on others’ rights or conduct illegal, threatening, fraudulent, or harmful activities.
To disrupt others’ use or enjoyment of the Service.
To introduce malicious software or viruses.
To attempt unauthorized access or interference with the Service or its systems.

6. Termination

We may suspend or terminate your access immediately for any breach of these Terms. You may terminate your account by discontinuing use and cancelling membership. Surviving provisions include ownership, disclaimers, indemnity, and limitations of liability.

7. Disclaimer

Our Services are provided “AS IS” and “AS AVAILABLE” without warranties of any kind. We do not guarantee uninterrupted or error-free access. You use the Services at your own risk.

8. Limitation of Liability

Recollections Within LLC and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages arising from your use or inability to use the Service, third-party conduct or content, or unauthorized access, even if advised of the possibility of such damages.

9. Indemnification

You agree to indemnify and hold harmless Recollections Within LLC and its affiliates against all claims, damages, and expenses arising from your violation of these Terms or misuse of the Service.

10. Jurisdiction and Applicable Law

These Terms are governed by the laws of the State of New Mexico, United States. Any disputes will be resolved exclusively in state or federal courts located in Bernalillo County, New Mexico, United States.

11. Changes to These Terms

We may modify these Terms at our discretion. Material changes will be communicated via website notice and/or email with a reasonable effective date. Continued use after changes means acceptance. If you disagree, stop using the Service.

12. Miscellaneous

Entire Agreement: These Terms, along with our Privacy Policy, Code of Conduct, and Community Values, constitute the entire agreement.
Waiver: Failure to enforce any term is not a waiver of that term.
Severability: Invalid provisions will be replaced to reflect original intent without affecting the remainder.
Assignment: You may not assign rights; we may assign our rights without restriction.
